Terms of Service
Please read these Terms of Service ("Terms") carefully before using Journey Tracker. By downloading, installing, or using Journey Tracker, you agree to be bound by these Terms. These Terms constitute a binding agreement between you and Apex Development Studio LLC.
1. Acceptance of Terms
By using Journey Tracker, you confirm that you are at least 18 years of age, have read and understood these Terms and our Privacy Policy, and agree to be bound by them. If you do not agree, do not use Journey Tracker.
2. Description of Service
Journey Tracker is a personal health tracking application designed to help individuals undergoing GLP-1 therapy monitor their health progress. Journey Tracker provides tools for tracking weight, body composition, medication history, side effects, laboratory results, and related health markers.
Journey Tracker also includes fitness and nutrition features:
- Strides: record walking, running, and other physical activities with a live map, distance, duration, step counts, and saved routes
- Route planner: plan a route on a map and follow it as an overlay on a future recorded activity. Planned routes are a follow-along guide, not turn-by-turn navigation
- Hydration tracking by drink type and protein tracking
- Apple Health sync for weight, body composition, activity, hydration, protein, and related health data you authorize
3. Not Medical Advice — Important Disclaimer
Journey Tracker is not a medical device, does not provide medical diagnoses, and does not constitute medical advice.
Nothing in Journey Tracker is intended to diagnose any disease or health condition; recommend or prescribe any medication or treatment; replace the advice of a licensed healthcare provider; or constitute the practice of medicine, nursing, or any other healthcare profession.
Always consult with your prescribing physician or other qualified healthcare provider before making any decisions about your health, medications, or treatment plan. Do not disregard or delay seeking professional medical advice based on anything you read or see in Journey Tracker.
Exercise disclaimer: Journey Tracker's fitness features track the activities you choose to record; they do not prescribe exercise. Consult a qualified healthcare provider before beginning any exercise program. Stop exercising and seek medical attention if you feel pain, dizziness, shortness of breath, or otherwise unwell.
In a medical emergency, call 911 or your local emergency number immediately.
4. Subscriptions and Payments
4.1 Free Trial or Purchase Required
Journey Tracker requires an active Journey Tracker Pro subscription, a one-time lifetime purchase, or an active free trial. When you first open the app, you must start the seven (7) day free trial, purchase Journey Tracker Pro, or restore a previous purchase in order to use Journey Tracker. Journey Tracker does not offer a standalone free version.
4.2 Journey Tracker Pro
Journey Tracker Pro is available as a monthly or annual subscription, or as a one-time lifetime purchase. Pro features include laboratory result tracking, lab report scanning (OCR import), and additional features as described in the app.
4.3 Free Trial and Basic Tier
Eligible new subscribers receive a seven (7) day free trial of Journey Tracker Pro. Your subscription will automatically convert to a paid subscription at the end of the free trial unless you cancel before the trial ends.
If your free trial ends without converting to a paid subscription, or a paid subscription later expires, Journey Tracker reverts to a limited basic tier that retains core tracking features (such as recent measurement history, basic injection logging, and basic activity recording) as described in the app. The basic tier does not include laboratory result tracking or other Pro features, and is available only as a fallback after a trial or subscription ends — it is not offered as a standalone free tier.
4.4 Billing
All subscriptions are billed through Apple's App Store. Your payment information is managed entirely by Apple. We do not store payment card information. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
4.5 Cancellation and Refunds
You may cancel your subscription at any time through iOS Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period. Refunds are subject to Apple's App Store refund policy.
5. User Responsibilities
You agree to:
- Provide accurate health information to the extent you choose to use the tracking features
- Use Journey Tracker only for lawful personal health tracking purposes
- Not attempt to reverse-engineer, decompile, or extract the source code of Journey Tracker
- Not use Journey Tracker in any way that could harm other users or third parties
- Maintain the security of your Apple ID and device
Safety while recording activities. When using Strides or following a planned route, you agree to stay aware of your surroundings and obey all traffic laws and signals. Planned routes are a follow-along overlay, not turn-by-turn navigation — they do not account for road closures, traffic, terrain, or hazards. Do not look at or interact with your device while driving, cycling, or in any situation where doing so is unsafe or unlawful. You are solely responsible for your safety and your choice of route.
6. Data Ownership
You own your health data. We do not claim any ownership over the health information you enter into Journey Tracker. This includes your recorded routes, planned routes, and all activity data collected through Strides — that data is yours. Our right to process your data is limited to operating the features of Journey Tracker as described in these Terms and our Privacy Policy.
7. Intellectual Property
Journey Tracker, including its design, features, code, branding, and content (excluding your personal health data), is owned by Apex Development Studio LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on Journey Tracker without our express written permission.
8. Disclaimers and Limitation of Liability
8.1 No Warranty
Journey Tracker is provided "as is" without warranty of any kind. We do not warrant that Journey Tracker will be error-free, uninterrupted.
8.2 Limitation of Liability
To the maximum extent permitted by applicable law, Journey Tracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages arising from health decisions made based on Journey Tracker .
Our total liability to you for any claims arising from your use of Journey Tracker shall not exceed the amount you paid for Journey Tracker in the twelve (12) months preceding the claim.
8.3 Health Decisions
We expressly disclaim all liability for any health outcomes, adverse events, or consequences resulting from reliance on Journey Tracker's tracking features. Health decisions must be made in consultation with qualified healthcare providers.
9. Indemnification
You agree to indemnify and hold harmless Journey Tracker from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of Journey Tracker in violation of these Terms or applicable law.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the app. Continued use of Journey Tracker after such notification constitutes acceptance of the updated Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
11.1 Binding Arbitration
Any dispute or claim arising from or relating to these Terms, your use of Journey Tracker, or any related matters between you and Apex Development Studio LLC shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court. Arbitration proceedings shall take place in the State of Delaware, or at a mutually agreed upon location.
11.2 Class Action Waiver
You agree that any arbitration or legal proceeding shall be conducted on an individual basis only and not as a class, consolidated, or representative action. You waive your right to participate as a plaintiff or class member in any class action lawsuit, class-wide arbitration, or any other proceeding where a person acts in a representative capacity. If this class action waiver is found unenforceable for any reason, the entirety of Section 11.1 shall be deemed void.
11.3 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
